Latest Timelines for Filing Adjustment of Status

If you are considering filing a family-based adjustment of status application, USCIS recently published a bulletin about the timeline for filing applications based on your priority date.

The application eligibility start dates above are broken out based on the level of family preference on your visa and the origin country. If your priority date is earlier than the date listed in the chart, you are eligible to file your adjustment of status application.

Your priority date is the day when your relative filed the I-130 immigrant visa petition with USCIS on your behalf. So, if you are a spouse of a lawful permanent resident (F2A) from Mexico, you are eligible to file for your adjustment of status on September 1st, 2023.

USCIS Announces Temporary 540-Day Extension on EAD Renewals

Previously, the United States Citizenship and Immigration Services (USCIS) has granted an automatic 180-day extension on work authorization documents (EAD) while the renewal application is pending, for certain categories.

So long as the Form I-765 renewal application is filed before the expiration date of the current EAD and the applicant is renewing in the same category, the automatic extension applies.

However, due to historically long processing times, USCIS has extended the automatic extension from 180 days to 540 days, while a renewal application is filed and pending.

This rule is in place until October 26th, 2023, at which time they will revert back to the normal 180-day extension.

This additional automatic extension applies only to certain categories, including Refugees ((a)(3)), Asylees ((a)(5)), TPS Granted ((a)(12)), VAWA Self-Petitioners ((c)(31), and several other categories.
