Alert: USCIS Issues Significant Update on Process for Adjustment of Status

On May 22, 2026, USCIS announced a significant policy memorandum regarding Adjustment of Status (AOS) under section 245 of the Immigration and Nationality Act (INA), signaling a potentially major shift in how Green Card applications filed within the United States may be adjudicated.

The memo asserted that Adjustment of Status is a matter of discretion and it was never designed to supersede the regular consular processing of immigrant visas, which normally takes places outside the United States at U.S. consulates abroad.

This announcement raises significant questions for many immigrants and families who have historically relied on Adjustment of Status pathways. However, the practical impact of this policy remains uncertain and may depend on future implementation, legal challenges, agency guidance, and how officers interpret and apply these standards in individual cases.

Spojmie Discusses Recent Court Ruling Trump Travel Ban is Unconstitutional

Earlier this month, a federal judge in Massachusetts granted a preliminary injunction against the Trump Administration's policy that stopped processing immigration applications for applicants who were from countries listed under Trump's travel ban.

The decision held that the travel ban policy was broadly discriminatory and that the Trump Administration had failed to reasonably demonstrate that individuals from those 39 countries on the travel ban list posed credible risks to national security or public safety.

As a result, the judge found that the Trump Administration was violating the law by directing the USCIS to not process immigration applications for individuals from those 39 travel ban countries. 

Immigration attorney and AACO board member Spojmie Nasiri produced multiple videos about the ruling and how it impacts applicants from the travel ban countries. The videos were recorded in English, Pashto, and Dari/Farsi. 


ReadyNow! App Helps Families Stay Connected and Protected

As immigration raids continue across the country in public spaces and workplaces, immigrant families experience fear and uncertainty every time a loved one leaves the house. To help families stay connected, protected, and supported, the organization Human Rights First has launched a secure, one-click emergency alert system called ReadyNow! to help people at risk of detention to notify their trusted contacts. 

This mobile app allows you to identify your support network and send an instant notification to your designated contacts if you are facing arrest or deportation.  

Users can record instructions related to child care, personal safety, legal defense, and more in case of an emergency, and have that information securely distributed to those listed as trusted contacts. 

All data stored on the mobile app is encrypted for security and privacy. If the alert button is ever pressed, the data is sent to your support network and then wiped completely from the device.

Users can also choose the option to be connected to a network of no-cost legal support services, that are matched to the user once the emergency alert button in the app is pressed. 

We encourage you to download and set up the ReadyNow! app, so that you are best prepared in case you face arrest or deportation. 


Client Flyer: Protect Yourself from Immigration Scams

The immigration crackdown from the Trump Administration has caused panic and confusion for immigrant communities. USCIS is making changes at a rapid pace regarding the various immigration processes and procedures. All the while, Immigration and Customs Enforcement (ICE) is intimidating and terrorizing immigrants in their homes and in public spaces. 

As immigrant families and communities try to grapple with the politically-charged immigration law ecosystem, unfortunately there are opportunistic scammers who prey on the confusion and chaos that immigrants are experiencing in order to steal money. 

In conjunction with the American Immigration Lawyers Association (AILA), our firm has put together a helpful flyer - in English and in Spanish - for how to protect yourself from immigration scams. The flyer provides detailed information about how scammers operate, how you should check to see if a legal service provider is legitimate, and what signs you should look for if you suspect a provider may be trying to scam you.

 Spojmie Speaks at 2026 ABA International Law Section Annual Conference

Earlier this month, immigration attorney Spojmie Nasiri travelled to the nation's capital in Washington D.C. to speak at the 2026 Annual Conference for the American Bar Association's International Law Section.

Spojmie presented on a panel of immigration law experts that included:

  • Jennie Guilfoyle, Partner at SAIL Strategic Academy
  • Charles Cain, Associate at King & Spalding 
  • Jennifer Callaghan, Senior Pro Bono Lawyer at A&O Shearman

The presentation was titled "The Long Road to Safety: Immigration Pathways and Ethical Advocacy for Afghan Allies Around the Globe" and was sponsored by the ABA ILS Afghan Legal Professionals Task Force.

Spojmie and her fellow speakers discussed the Special Immigration Visa (SIV) processes, humanitarian parole, third-country processing, and best practices for how lawyers can work together to provide a lifeline to Afghans who fought for democracy alongside international forces for 20 years. They presented to the audience of legal professionals about how to access specialized training and how to leverage resources to help Afghan allies and their families.
